The Justice Department has reportedly issued subpoenas to compel Reddit and X to give federal prosecutors the names, addresses and banking details of users who have criticized the government’s deportation efforts.

The U.S. Attorney’s Office for Washington has subpoenaed social media companies as part of criminal probes, seeking personal information about at least two accounts that have rebuked immigration enforcement efforts, according to records that the users’ attorneys shared with Bloomberg.

The users have not been told what possible offenses are being investigated, but their lawyers believe it could relate to allegations of revealing a federal officer’s location.

While the Justice Department previously used administrative summonses, a tactic to compel the recipient to provide documents that does not require prior court approval, it’s now seeking grand jury subpoenas in at least two cases.

Lauren Regan, an attorney representing one user, said that the move is “further proof that this is a bad faith attempt to unmask the user.”

Ms. Regan said some of her client’s posts were “expletive ICE,” but she suspects that the government is investigating a post that appeared to reference the ICE agent who fatally shot Minnesota protester Renee Good, including where the agent lived.

Reddit notified the user in early March about an administrative summons from Homeland Security Investigations, a division of the Department of Homeland Security. The summons reportedly cited a law related to customs compliance to uncover the identities of the anonymous online critic.

The summons was allegedly withdrawn two weeks after a request was filed in federal court to challenge it. The grand jury subpoena was then issued to Reddit on March 31, according to multiple reports.

Joshua Koltun, a First Amendment lawyer, is representing a user who posted what he described as a sarcastic post about donating to the ICE officer who shot Good, including an address the user had seen elsewhere on social media.

X notified the user in mid-March that it had received an administrative summons to hand over the user’s information. Mr. Koltun then filed a request with a federal judge to contest it, but learned by May that the DHS had withdrawn the summons and that the Justice Department had issued the grand jury subpoena to X.

The grand jury subpoenas reviewed by Bloomberg were signed by Brendan Horan, a prosecutor in the U.S. Attorney’s Office for Washington who has been involved in cases related to alleged threats against federal officials.

The subpoenas instruct the companies to deliver records to an ICE office. One states that the request was “pursuant to a criminal investigation being conducted by the United States Attorney’s Office.”

A federal judge is reportedly weighing the users’ requests to have the government’s subpoenas tossed out.
