Maybe it’s the hairs on the back of your neck standing up. Or perhaps it’s a shiver running through you inexplicably. Whatever the sign, everyone knows the feeling of suddenly realizing someone is watching you.
One woman had a particularly rattling experience at a Martin’s grocery store in Winchester, Virginia. Not only was a man watching her; she says he was recording her.
Emily Rios (@emilyyrios) posted a video about the creepy realization on TikTok. In it, she explained that she caught a man “recording women’s butts,” which she said included hers.
As of this writing, her post has more than 25,000 views.
What happened in the grocery store?
Rios was in the grocery store with her family and was heading toward checkout. That’s when a man came the “opposite way” toward them.
“I was like, ‘This guy just looks, like really sus.’ He just looked weird. As soon as we started walking, he immediately turns and starts following us,” Rios said.
Rios couldn’t shake the feeling that something was off about the man. She told her partner to grab their child because she thought he might try to abduct them. But she said she realized that he was doing something else entirely.
“I literally saw him take his phone and, like go under women’s butts, like recording them while they’re walking, while they’re with their children. And I said, ‘Matt, Matt, Matt, he’s recording, like people’s butts,’” Rios said.
She said he may have recorded her. Rios says she then saw the man record another woman in the store.
What did the man have to say for himself?
She says her partner, Matt, walked up to the man to confront him. The man denied recording anyone, but Rios said that Matt continued asking him about the pictures he had allegedly been taking in the store. At one point, Rios said Matt threatened to break the man’s arm and take his phone.
“The man essentially starts salivating,” Rios said. Matt did not relent, she continued. Eventually, the man beat a path to the exit, she said.
“This man ran out of the store so quickly,” Rios said. “ Insane.”
Rios didn’t respond to an email seeking comment.
What the law says about videoing people without consent
Many people feel that it’s rude and invasive to video strangers without consent. But it is legal, so long as there isn’t a reasonable expectation of privacy.
Examples of places where one has a reasonable expectation of privacy include locker rooms, bathrooms, hotel rooms, and private residences.
Videoing strangers in public spaces can run afoul of the law if one records private parts, such as up women’s skirts, if it crosses into harassment or stalking, or if the footage is published for commercial gain. But there’s no indication that was the case in this instance.
That said, Rios and her partner could have informed Martin’s employees that someone was recording people without consent and asked them to kick him off the premises. In most situations, businesses oblige these requests if there is reason to believe that the accusation is true, which can be easily proven with security footage.
Martin’s Super Markets’ parent company SpartanNash did not respond to an inquiry sent via online contact form.
How did viewers react?
Some commenters said they’re from Winchester, Virginia, where the incident took place. They reflected on the Martin’s location, which they said is on Pleasant Valley Road.
“I live here and sad and so disturbing. This is nothing new,” one viewer said.
Another added, “Well that’s Winchester lol….
Viewers said they’ve had similar experiences in the area and alleged that it’s unfortunately a common issue.
“Lmao fyp getting too local and me too. This has happened in the gym,” one person said.
