A first-time mom who carried twin babies to term before being forced to give them up has settled with the fertility clinic which ‘unimaginably’ implanted her with embryos from two other women.

The Korean-American couple from New York City only discovered the appalling mix-up in the delivery room when the twin girls they had been told to expect turned out to be two Caucasian boys.

The couple named in court papers as YZ and AP had struggled for years to conceive before spending $100,000 at the Cha Fertility Clinic in Southern California.

But just six weeks after becoming parents a court ordered them to hand over the babies they had so looked forward to.

And it left them with ‘permanent emotional injuries from which they will not recover’, their lawsuit claimed.

‘They may never know what happened to their embryos, as well as whether the currently cryopreserved embryos are genetically matched to them,’ it added.

Custody of one of the boys was awarded to its genetic mother Anni Manukyan and her husband Ashot who also sued the clinic.

Anni and the other boy’s genetic mother had all been at the clinic on the same day in August 2018 when AP was implanted with their embryos, and Anni herself was mistakenly implanted with the embryo of a fourth couple.

That pregnancy failed and the couple were completely unaware they had become parents until they received a call from the clinic asking them to take a DNA test in March 2019.

AP meanwhile had been told to ignore scan results suggesting the girls she was expecting were in fact boys with clinic co-owner Joshua Berger telling her his wife had seen the same anomaly while pregnant.

Anni spoke of her heartbreak and the trauma of fighting the boy’s birth mother in court after winning custody of the little boy she named Alec.

‘They came in and they were crying, and I saw them crying and I started bawling,’ she recalled.

‘My husband was trying to hold me. Even the security guard was crying.’

AP had written to the court: ‘I kiss his little feet every day. I give him a bath. I breast fed him.

‘We’re their true parents and we’re the ones who want to be with him. We love them, they’re ours and they’re twins, they shouldn’t be separated.

‘They snuggle with each other, they sleep with each other every night. How could you separate them?.’

Anni claimed that she broke down as the judge gave his verdict, saying: ‘DNA is DNA and genetics play a big role in everything, so the baby belongs with Anni and Ashot.’

As they waited for the handover a psychiatrist informed the Manukyans that they should hand over their pillowcases so their son could become accustomed to their smell, and recordings of Anni reading.

‘My voice was shuddering while I was doing it,’ Anni said.

‘It was just heart shattering. Me and my husband, we wondered what if the pillows we slept on, what if the scent wasn’t enough? We were hugging the pillowcases just to make sure.’

Eventually the day came for the handover baby Alec in her lobby of a New York hotel.

‘They were saying ‘we’re sorry, we’re so sorry’, Anni said.

‘We should have let you guys come and take him before, it’s just that we love them. We wanted to take care of them as they were our own. We love them’.

‘There was no tension in the room whatsoever. It felt like we were friends… It was just love, because we all have love of the same child.’

When the couple handed over the baby in May, they also handed over a series of gifts for the Manukyans’, including gold bracelets, one celebrating the Year of the Pig and another with a crown; and a ring emblazoned with tiny baby shoes.

‘I would like you to give this to him, to know it’s from me,’ AP told Anni.

A week after giving Anni and Ashot their baby, AP and YZ relinquished Alec’s ‘twin’ to his biological family.

AP and YZ won a $200,000 settlement against clinic co-owner Joshua Berger in October and have now settled for an undisclosed sum against the clinic.

In their lawsuit they admitted they ‘could not find the courage and the way to tell others about their devastating loss’.

Anni who settled her case against the clinic in 2019 said she prays every day for the woman who gave birth to her son.

‘She carried my child for nine months, she fed him, she took care of him, she changed his diapers. It could have ended up differently.

‘I pray for her every day, she was a victim of this as much as I am.

‘She’s a lovely lady. She raised my baby inside of her and after he was born.’

Attorney Adam Wolf, who represented the Manukyans said: ‘This incredible series of events demonstrates CHA’s shocking incompetence.

‘While I have handled hundreds of cases of fertility-center misconduct, this tragedy at CHA is among the most egregious I have seen.

‘Anni and Ashot put all their faith and trust in CHA. In return, CHA gave Anni and Ashot lies, excuses and heartbreak.

‘It’s fair to assume there are far more fertility clinic tragedies that happen than we know.’
